Limited Scope Retainer
Status Certificate Review Service Terms and Conditions
You are agreeing to retain myAbode Law Professional Corporation for the limited purpose of reviewing a Status Certificate provided to you in accordance with the Condominium Act. To ensure that there is no confusion about the scope of our retainer or about the work we will and will not be doing for you in relation to the potential purchase of a property we have entered into the following Limited Scope Retainer Agreement. The specifics of our limited scope retainer are as follows:
This agreement is between myAbode Law Professional Corporation, hereafter referred to as the “Lawyer” or “myAbode Law” and you, the “Client”. By acknowledging the terms of this retainer below and clicking “I agree” you are agreeing to the terms and conditions set out in this Limited Scope Retainer Agreement.
Scope of Retainer
myAbode Law will only review and provide you with a summary opinion on the Status Certificate that you have provided to myAbode Law. myAbode Law is not retained to review the Agreement of Purchase and Sale, to conduct any title search, or to review, consider, or search any other documents or registries. The scope of the review will be limited to the review of the Status Certificate and documents attached to the certificate and no independent searches will be conducted. We would be happy to represent you on a property transaction and would require a further engagement letter to do so.
Client Responsibilities and Control
The Client will remain responsible for communicating with their agent or the property owner regarding the status of any condition or conditional period. The Client agrees to:
- Cooperate with the Lawyer or his/her office by complying with all reasonable requests for information in connection with the matter for which the Client is requesting services;
- Review and evaluate all information provided by the Lawyer;
- Immediately notify the Lawyer of any changes of email addresses or telephone numbers of the Client;
- Immediately notify the Lawyer if the Client receives any new information regarding the Status Certificate.
Limitation of Lawyer's Responsibilities
myAbode Law will perform the specific legal tasks identified in section 1 and nothing more consistent with the myAbode Law’s ethical and professional responsibilities, based on the information available to the myAbode Law. In providing those services, the Client agrees that the Lawyer will not do the following:
- Review the agreement of purchase and sale
- Conduct a title search
- Communicate with the seller of the property or negotiate on behalf of the Client
- Communicate with respect to any conditions or conditional periods
- Prepare any documents or act in any way on the property transaction
Method of Payment for Services
I, the Client, confirm that I will pay, in advance of myAbode Law starting the review of the Status Certificate, the fee of $99.00 + HST. I agree that no work will be done without the payment of the fee. I, the Client, confirm that myAbode Law will not be liable for any third party costs incurred or payable in connection with the Status Certificate review.
Confidentiality and Email
myAbode Law will comply with all professional obligations to maintain the confidentiality of information provided by the Client, subject to any exceptions required or permitted by law. The Client acknowledges that email communication is not entirely secure and may be subject to interception or unauthorized access. By engaging the Lawyer and providing an email address for correspondence, the Client consents to the use of email for communication and accepts the associated risks. If the Client prefers alternative methods of communication, it is their responsibility to inform myAbode Law in writing.
